The Italian Communications Authority (“AGCOM”) has launched a public consultation on the proposed amendments to the regulation on copyright enforcement in electronic communications networks, which was introduced with AGCOM deliberation No. 680/13/CONS and entered into force on April 1, 2014 (“Regulation”).
On May 19, 2020, the Italian government adopted decree law No. 34, which sets out urgent measures with immediate effect to support health, work, and the economy, as well as social policies related to the epidemiological emergency (“Decree”). Article 195-bis of the Decree granted new powers to AGCOM to further combat copyright infringements in electronic communications networks.
AGCOM proposed some amendments to the Regulation accordingly. More specifically, the changes made available for public consultation are intended to prevent the dissemination of digital works that have been made available in violation of copyright, with the same procedures and guarantees that have marked AGCOM’s actions since the entry into force of the Regulation.
AGCOM invites stakeholders to submit their comments on the draft amendments to the Regulation. Such comments should be submitted in the form of amendments to the relevant articles and must be submitted no later than December 2, 2020 (more information available here).
