Cross-border posting in Italy: new rules applicable to the mandatory communications as of december 26, 2016

On October 27, 2016, the Italian Ministry of Labor and Welfare published in the National Official Gazette the Decree of August 10, 2016 (the “Decree”), providing new rules applicable to the mandatory communication to be made by employers before the starting date of the secondment of their employees in Italy.

According with the Decree, within 24 hours from the starting date of the posting, the employer shall communicate to the Italian Ministry of Labor and Welfare all mandatory information related to the seconded employee(s), the hosting entity/local unit based in Italy, where the employee(s) will be seconded, and the secondment period by filling in the standard form «UNI Distacco_UE», available at the website of the Italian Ministry of Labor and Welfare, www.lavoro.gov.it. Always within 24 hours from the starting date of the posting, employers may revoke the communication sent to the Italian Ministry of Labor and Welfare in relation to the proposed secondment.

Moreover any other change related the secondment must be communicated by means of «UNI Distacco_UE» form within the subsequent 5 days.

The Decree will entry in force on December 26, 2016.
